Terms of Use

These Terms of Use (the "Terms") govern your use of the Tixo apps for iPhone and Android, our website, and every related service (together, the "Service"). The Service is operated by Tixo, an independent service run by its developers and not yet incorporated ("we", "us", "our").

By creating an account, accepting these Terms in the app, or otherwise using the Service, you agree to these Terms, to the Privacy Policy and to the Price & Listing Disclaimer, which form an integral part of them. If you do not agree, please do not use the Service.

Tixo is a catalogue of events and of the tickets that sellers offer for them. It does not sell tickets. Prices and details shown in it are information only — the binding price, fees and terms are the ones the seller presents on its own page when you buy. Every purchase is made on the seller's own website, under the seller's terms.

1. What the Service does

The Service gathers into one catalogue the events — concerts, theatre, stand-up, festivals, sport, cinema, lectures, family shows and more — that ticket sellers in Israel list publicly: box offices, ticketing platforms, venues and producers. Each show has a page with its upcoming nights and, for the night you pick, the sellers that list it. When you choose a seller, the Service opens that seller's own page for that night — in a window inside the app on a phone, or in a new browser tab — so that you can buy there. A purchase is one show, on one night, from one seller; the Service has no basket and no checkout of its own.

The Service does not sell tickets, does not take payment, does not issue or deliver tickets, and is not the organiser or producer of any event or the venue where it takes place, nor an agent, broker or representative of any seller. It is independent of the sellers it lists and is not sponsored, approved or endorsed by any of them. It is offered to consumers for personal, non-commercial use.

The Service is provided free of charge. We may offer paid features in the future; their price and conditions will be presented to you before you subscribe. The Service shows no advertising; if that ever changes, advertising will be clearly marked as such and will never change the order in which the sellers of a show are listed.

2. Who may use the Service

You must be at least 18 years old to create an account. If you are under 18, you may use the Service only with the consent and under the supervision of a parent or legal guardian, who accepts these Terms on your behalf. By using the Service you confirm that you are legally capable of entering into this agreement.

3. Your account

  • The apps are used with an account. You may sign up with an e-mail address and a password — the address is confirmed with a six-digit code we e-mail to it — or with "Continue with Google". Provide accurate details and keep them up to date.
  • Your account is personal. Keep your password secret and do not let others use your account. You are responsible for everything done through it. Tell us at once at info@tixo.co.il if you suspect unauthorised use.
  • We may suspend or close an account that breaches these Terms, is used abusively, or that we reasonably believe endangers the Service, other users or third parties.
  • You can delete your account at any time from Account → Delete account (see the Account & Data Deletion page). Deletion is permanent.

4. Information shown in the Service

Show names, descriptions, pictures, dates, times, venues, prices, fees, availability and the links to each seller's page are gathered automatically, by software, from the web pages and feeds that sellers publish to the public, several times a day, and may be incomplete, out of date or wrong. Venue addresses and map points come from OpenStreetMap. Rows marked "sample" are illustrative and were not read from the seller. All of it is information to help you find and compare, not an offer. The binding price, fees, seats and terms are the ones the seller presents on its own page when you buy. The Price & Listing Disclaimer explains the sources and their limits in detail and forms part of these Terms.

5. Buying tickets at a seller

  • Every purchase you make after using the Service is made directly with the seller, on the seller's own website, and is governed solely by the seller's terms of sale, privacy policy and cancellation, refund and exchange policy. We are not a party to that purchase.
  • When you continue to a seller, the Service opens the seller's page for the night you chose. Before you pay, check on that page the show, date, time, venue, seats, quantity, price, fees and total. The Service fills in nothing on the seller's page and never sees your payment details.
  • The seller and the event's organiser alone decide prices, fees, seating, ticket delivery and availability, and are responsible for the event itself. A cancelled, postponed or moved event, a refund, an exchange or a ticket that did not arrive is a matter between you and the seller or the organiser, under their terms and Israeli consumer-protection law. That law limits, and in some cases excludes, the right to cancel a remote purchase of tickets to an entertainment or leisure event; the seller applies those rules.
  • The "My tickets" screen is our own record of the shows you sent to a seller: a record is written when you open the confirmation for a seller, removed if you close it without continuing, and otherwise corrected by what happened next, such as whether the seller's page opened. You can mark a record as bought or delete it. It is not a ticket and not the seller's order confirmation — your tickets and their confirmation come from the seller.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or in breach of a seller's terms;
  • copy, scrape, crawl, mirror, harvest or systematically extract data, listings, prices, images or other content from the Service, whether manually or by automated means, or use such content commercially, without our prior written consent;
  • reverse-engineer, decompile, or attempt to derive the source code of the Service, or interfere with its security, its servers or its networks;
  • circumvent access controls, rate limits or other restrictions of the Service;
  • send malicious code, or content that infringes the rights of others, including in a problem report;
  • impersonate any person, or misrepresent your relationship with us or with any seller;
  • use the Service, or content obtained from it, to build a competing product or a data set, or to train machine-learning or artificial-intelligence models.

7. Content you provide

The shows you save, the artists, venues and cities you follow, your ratings and searches, a note you add to a problem report and anything else you enter remain yours. You grant us a non-exclusive licence to store and process them solely in order to provide the Service to you, and to use a problem report to check and correct the catalogue. We do not review your content, but we may remove content that breaches these Terms or the law.

8. Intellectual property

The Service — its software, design, text, logos, catalogue compilation, the matching of listings into shows and nights, its ranking logic and its databases — is owned by us or our licensors and is protected by copyright and other intellectual-property laws. You receive a personal, limited, revocable, non-transferable licence to use the Service for its intended purpose. No other right is granted.

Seller, venue, artist and producer names, logos, show titles, descriptions and pictures belong to their respective owners and are used only to identify the shows and sellers listed. Listing data gathered from public sources remains the information of its sources; our compilation, processing and presentation of that data are ours. Venue addresses and map points are © OpenStreetMap contributors and are available under the Open Database License.

9. Third-party services

The Service relies on and links to services operated by others: the sellers' websites, Google (if you choose to sign in with it), map and navigation services, messaging and sharing apps, our hosting provider and our e-mail delivery provider (see the Privacy Policy). Their terms and privacy policies govern your use of them. We do not control them and are not responsible for their content, availability, accuracy or conduct. Opening a seller's page from the Service is your decision and at your own risk.

10. Automated features

The catalogue is built automatically by software: it gathers the listings, matches the listings of one show from different sellers into one show and one night, files shows by category, orders the sellers by price and marks the cheapest seller of a night. Notifications about the shows you saved and the artists, venues and cities you follow are worked out by software in the app, on your phone. The Service uses no artificial-intelligence models. Software makes mistakes, and its output may be inaccurate or incomplete. It is information, not advice, and you must check it before relying on it.

11. Availability, changes and termination

We may change, suspend or discontinue any part of the Service at any time, including data sources, listed sellers and features, with or without notice. The Service may at times be unavailable or slow. We may terminate or suspend your access if you breach these Terms. You may stop using the Service at any time and delete your account.

12. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, completeness, currency, availability, merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that any seller will honour a price or availability shown in it, that any event will take place as listed, or that a seller's page will open on the night you chose.

13. Limitation of liability

To the fullest extent permitted by law, we, our owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, profit, data or goodwill, arising from or in connection with the Service — including from reliance on any price or information shown in it, from a purchase made with a seller, from an event that was cancelled, postponed or changed, or from a seller's page that did not open or opened on the wrong night. Because the Service is provided free of charge, our total liability for all claims relating to the Service will not exceed NIS 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory rights under the Consumer Protection Law, 5741-1981, and the Standard Contracts Law, 5743-1982.

14. Indemnity

You agree to compensate us for any loss, expense or claim arising from your breach of these Terms or of the law, or from your misuse of the Service, to the extent permitted by law.

15. Privacy

Our Privacy Policy describes the information we collect, why we collect it, who we share it with and your rights, and our Cookie & Storage Policy describes the cookies and on-device storage the Service uses. Both form part of these Terms.

16. Communications

We send you only the messages needed to operate the Service: the codes that confirm your e-mail address or reset your password, and notices about security, these Terms or your account. Notifications about shows you saved or follow appear only inside the app. We send no marketing messages and have no newsletter; should we ever send marketing messages, we will do so only with your prior consent, in accordance with section 30A of the Communications (Telecommunications and Broadcasts) Law, 5742-1982, and every such message will include a way to unsubscribe.

17. Changes to these Terms

We may amend these Terms from time to time. The version number and effective date appear at the top. For material changes we will give notice in the app or by e-mail at least 14 days before they take effect, where practicable, and will ask you to accept the new version in the app before you continue; for other changes, continued use after the effective date constitutes acceptance. The current version is always available in the app, from the Account screen, and at https://tixo.co.il/en/legal/terms.

18. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, and any dispute arising from them or from the Service may be brought before the competent court in Israel, without derogating from any mandatory provision of law that applies to you as a consumer.

19. General

These Terms, together with the documents they refer to, are the entire agreement between you and us concerning the Service. If any provision is held invalid, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours to a successor of the Service. These Terms are published in Hebrew and in English; in case of any inconsistency, the Hebrew version prevails.
